On August 20, 2026, the Beaver Lake Board of Directors approved the rules and regulations on DCF 368 for the use of e-bikes & e-scooters within the Beaver Lake Subdivision.

2. E-Bikes & E-Scooters
a. Definitions:
- E-Bike. For purposes of this regulation, an “e-bike” shall mean a bicycle equipped with operable pedals and an electric motor that aids the rider. This regulation applies to electric bicycles commonly recognized as Class 1, Class 2, and Class 3 e-bikes under Nebraska law, as well as personal electric scooters.
- E-Scooter. A two-wheeled device with a standing deck, powered by an electric motor and is controlled by handlebars and designed for one rider.
b. Operating Rules:
- E-bikes and e-scooters are permitted within the subdivision, subject to this regulation and any other applicable Association Covenants, Bylaws, Rules or Regulations.
- The maximum operating speed for any e-bike or e-scooter within the subdivision shall fall within the posted speed limit signs, unless a lower posted speed applies in a particular area, in which case the lower speed shall control.
- In areas where pedestrians are present or reasonably expected, including near mailboxes, trails, boat ramps, club facilities, parking lots, beaches, and other gathering areas, operators shall reduce speed to a safe and prudent pace not exceeding 10 miles per hour.
- Operators shall always yield to pedestrians and shall give an audible signal before overtaking a pedestrian or slower-moving user on a trail or shared-use area.
- Reckless operation, racing, excessive speed, wheelies, abrupt weaving through traffic or pedestrians, towing, and any operation that endangers persons or property are strictly prohibited.
- E-bikes and e-scooters may be operated only on roads, driveways, and areas where bicycles or similar devices are otherwise permitted. The Association may restrict or prohibit use in designated areas in the Board of Director’s sole discretion. Prohibited areas shall be designed by signage.
- No person may carry a passenger on an e-bike or e-scooter unless the device is specifically designed and equipped for passengers by the manufacturer.
c. Safety Requirements:
- All people operating or riding as a passenger (if permitted) on an e-bike or e-scooter within the subdivision are strongly encouraged to wear a properly fitted bicycle or multi-sport helmet fastened under the chin.
- Operators are strongly encouraged to wear other protective gear appropriate for riding conditions.
- Any e-bike or e-scooter may not be operated on Association property between the hours of half hour after sunset to half hour before sunrise, without reflectors or headlights.
- Each e-bike and e-scooter must be maintained in safe operating condition, including properly functioning brakes, tires, and steering components.
d. Minors and Supervision:
- Parents and guardians are responsible for ensuring that minors who operate e-bikes or e-scooters within the subdivision understand and comply with these regulations.
e. Enforcement:
- Violation of these regulations may result in a warning, liquidated damage monetary assessment, suspension of e-bike or e-scooter privileges on Association-controlled property, suspension of membership privileges, or other enforcement action authorized by the Handbook. Parents or guardians shall be held responsible for violations committed by minors and ultimately the Member of the Association as otherwise herein defined shall be responsible for violations of their family members, guests, or invitees.
- Fines: All E-bikes and E-scooters will follow the road rules as outlined in the Beaver Lake Handbook and are subject to liquidated damages if they are in violation.
f. Liability:
- People using e-bikes or e-scooters within the subdivision do so voluntarily and entirely at their own risk and remain responsible for complying with all applicable state and local laws, as well as the rules of Association promulgated in the Beaver Lake Association Handbook. The Beaver Lake Association, its Board of Directors, committees, officers, employees, agents, and volunteers shall not be responsible or liable for any accident, collision, injury, death, loss, or property damage arising out of or related to the ownership, operation, use, maintenance, or presence of any e-bike or e-scooter within the subdivision or on Association-controlled property. By operating or permitting the use of an e-bike or e-scooter within the subdivision, the user and the responsible Member acknowledge and accept these risks. Nothing in this regulation is intended to waive or limit any rights, duties, defenses, or remedies otherwise available to the Association or any resident.
g. E-Bike Classification:
Class 1 Electric bicycle, defined.

-Pedal assists only (motor works while pedaling) 20 mph
-Must have operating pedals
Class 2 Electric bicycle defined:
-2 wheels
-Throttle-assisted (motor can propels only while you are pedaling) 20 mph
-Must have operating pedals
Class 3 electric bicycle, defined.
-2 wheels
-Under 750watts
-Motor assists up to 25 mph.
-Must have operating pedals
-Throttle assisted
Class 4 (Electric motorcycle) defined.
-2 wheels
-Requires a motorcycle license
-Has an electric motor higher than 750watts
-Does not have operable pedals
- Any member that owns a 750watts OR higher rated electric bike, will need to be 17, registered with the county, provide a valid Class M motorcycle license and have insurance.
